EMS Officials Work to Restore Ryan White Legislation

WASHINGTON, D.C. -- National EMS officials are working to resuscitate a life-saving measure axed by Congress.

When a patient tests positive for HIV, AIDS or other serious illnesses, the hospital staff notifies the EMS personnel who handled the call.

Unless EMS officials are successful, that protection will be dropped.

The notification measure was eliminated when politicians reviewed the Ryan White legislation. "They apparently asked a number of people about why it was included, and no one justified it," said Lisa Meyer, of Cornerstone Government Affairs. "No one associated with EMS was asked."

Right now, the law remains intact. And, EMS officials are hoping to get that section restored.

If they are not successful, a hospital would be in violation of federal HIPAA laws if they notify responders, Meyer said.

On Thursday, EMS officials from various organizations including Cornerstone, NAEMT, IAFC and others will participate in a conference call to discuss the issue. "We will be talking about what we need to do to rectify it," Meyer said, adding that the stakeholders include emergency physicians groups as well.

"It's important that we get the provision. People need to know if they've been exposed to something," she said.

Ryan White Legislation Restored
The Ryan White legislation is essential to the health of all EMS providers. My question for those who are in a position to answer, is how did the restoration legislation get by in the first place without comment from EMS?

Ryan White Act modifications
What about the provisions that prevent us sharing information between providers about patients with HIV and AIDS? This would be a provision that should be permissable under HIPPA (the healthcare PORTABILITY ACT - which asks for streamlining how patient information is shared between providers).

Is that being addressed? It should be. This is the only group that gets this exmption, and its ridiculous for patient care and is a political needle in our nose.

Ryan White Legislation
We as EMS providers need this legislation. We are the forerunners of the emergency medical system. There are more people today using drugs and passing detromental disease around more than ever! We definately should have been at the top of the list to be asked. If we "catch something" from one of our pateints, we could take it home to our families, friends. I feel this would start an epidemic that could eventually go world wide! We ARE trying to prevent these diseases, not sped them!

Cabcelation of this law will put us all (EMS personnel) in even greater danger thatn we subject ourselves every day. Every day we deal with people from various backgrounds, we dont know what is in their blood. It is our right to know if we were exposed and to what.
